# Terms of Service — Naseej

## 1. Agreement to Terms
By downloading, installing, accessing, or using Naseej (the **“App”** or **“Service”**), you agree to be bound by these Terms of Service (the **“Terms”**). If you do not agree to these Terms, do not use Naseej.
These Terms form a binding legal agreement between you and the **Naseej team** (**“we”**, **“us”**, **“our”**).

## 2. Who Can Use Naseej
You may use Naseej only if:
- You are at least **13 years old**, or at least **16 years old in the European Economic Area** where applicable.
- You are not prohibited from using the Service under applicable law.
- You create and maintain an account through a supported sign-up method.
- You can form a legally binding agreement with us.
If you use Naseej on behalf of an organisation, business, or other entity, you represent that you have authority to bind that entity to these Terms.

## 3. Your Account
### Creating an account
You may create an account using a supported sign-up method, including email and password or Sign in with Apple, where available. You must provide accurate and complete information.
### Keeping your account secure
You are responsible for safeguarding your login credentials and for all activity that occurs under your account. If you suspect unauthorised access or a security incident, contact us immediately at **[email protected]**.
### One account per person
Unless we expressly allow otherwise, accounts are personal, non-transferable, and intended for use by one individual.

## 4. What Naseej Provides
Naseej is a personal planning, faith, and life-organisation app designed to help users manage daily life with more calm and structure.
Depending on your subscription tier, platform, app version, and feature availability, the Service may include:
- Prayer time calculation and prayer logging
- Quran reading progress, bookmarks, adhkar, duas, and faith guides
- Daily planning, task management, routines, anchors, and project tracking
- Wellness and self-care logging, including sleep, water, mood, habits, cycle tracking, movement, and meal-planning support
- Motherhood and family organisation tools, including child profiles, reminders, notes, meal plans, and grocery lists
- Finance-related organisation tools, including expenses, goals, savings, and budgeting support
- Study and work organisation tools
- An AI assistant experience, including “Ask Naseej”
- Widgets, notifications, reminders, and other companion features where supported by your device or platform
We may add, remove, modify, suspend, or discontinue features at any time. Some features may be experimental, region-specific, platform-limited, subscription-limited, or unavailable on certain devices.

## 5. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of applicable law
- Attempt to gain unauthorised access to our systems, infrastructure, or another user’s account
- Reverse engineer, decompile, disassemble, or attempt to extract source code from the App, except where legally permitted
- Use the Service to upload, transmit, or store harmful, abusive, offensive, fraudulent, or infringing content
- Interfere with or disrupt the operation, security, or integrity of the Service
- Scrape, copy, mirror, or redistribute content, data, or materials from the App without permission
- Impersonate any person or entity or misrepresent your affiliation with them
- Use affiliate, referral, or promotional systems in a misleading, abusive, or fraudulent way

## 6. Your Content
### Ownership
You retain ownership of the content you create, upload, or store in Naseej, including tasks, notes, logs, reminders, preferences, and similar personal content.
### Licence to us
You grant us a limited, non-exclusive, revocable licence to host, store, process, reproduce, and display your content solely as necessary to operate, maintain, secure, improve, and provide the Service to you.
### Your responsibility
You are responsible for the content you enter into the Service. You must not enter personal or sensitive information belonging to another person unless you have the legal right and appropriate permission to do so.

## 7. Family, Child, and Shared Information
Naseej may allow you to store family- or child-related information, such as child names, ages, reminders, allergies, routines, and notes.
You are responsible for ensuring that:
- You are authorised to enter and manage that information
- The information you enter is lawful and appropriate
- You do not enter another person’s sensitive personal data without permission
Naseej is intended for use by the account holder. It is not designed for children to independently create their own accounts unless expressly stated otherwise.

## 8. AI Assistant (“Ask Naseej”)
Naseej may include AI-powered features, including the AI assistant currently referred to as **“Ask Naseej.”**
AI features are intended to support planning, organisation, and general informational assistance. You understand and agree that:
- AI responses may be inaccurate, incomplete, outdated, or inappropriate for your situation
- AI output is **not** a substitute for professional advice
- AI responses are **not religious rulings (fatwas)**, medical advice, legal advice, financial advice, mental health treatment, or emergency guidance
- You are solely responsible for how you interpret or act on AI-generated content
- We are not responsible for decisions or actions taken in reliance on AI-generated content
If AI functionality is provided through third-party models or services, their underlying systems may influence response quality and availability.

## 9. Prayer Times and Faith Features
Prayer times in Naseej are calculated using the `adhan` open-source library and standard Islamic astronomical calculation methods, together with the settings and location information available in the app.
You understand and agree that:
- Prayer times may vary by method, location, timezone, or configuration
- We cannot guarantee exact accuracy for every user or every location
- Prayer times should be verified with local mosque schedules or trusted local authorities where precision is important
- We are not responsible for any religious obligation, timing discrepancy, or worship outcome affected by reliance on calculated times in the App
Faith-related informational content is provided as a supportive aid and should not be treated as authoritative religious instruction.

## 10. Health, Wellness, and Finance Features
### Health and wellness
Naseej may include wellness features such as cycle tracking, mood tracking, sleep logging, water intake, movement, self-care, and meal-planning support.
These features are provided for **personal organisation and informational purposes only**. Naseej is **not a medical device** and does not diagnose, treat, monitor, or prevent disease or health conditions. Always seek appropriate medical advice from a qualified professional for health concerns.
### Finance
Naseej may include budgeting, saving, expense-tracking, and goal-setting tools.
These tools are provided for **personal organisation and informational purposes only**. They do not constitute financial, investment, accounting, tax, or legal advice, and do not create a regulated financial-services relationship.

## 11. Subscriptions, Trials, and Payment
Naseej may offer free trials, paid subscriptions, and multiple subscription tiers.
### Free trial
If offered, a free trial gives eligible new users access to paid features for a limited period. Unless otherwise stated in the app, your trial will automatically convert into a paid subscription unless cancelled before the trial ends.
### Paid plans
Naseej may offer more than one subscription tier. Features available to you may vary based on your active plan, platform, region, app version, and promotional eligibility.
### Billing and renewal
Subscriptions renew automatically unless cancelled before the end of the current billing period. Billing, renewal, cancellation, refunds, and payment processing are handled by the Apple App Store or Google Play Store, as applicable, and are subject to the terms and policies of that platform.
### Price changes
We may change pricing, introduce new plans, remove plans, or change feature access in the future. We will provide notice where required by law or platform rules.
### Expiry or failed payment
If your free trial ends, your subscription expires, or a renewal payment fails, your access to paid features may be reduced, suspended, or removed at the end of the applicable access period.
### Restores and account state
Where supported, you may be able to restore prior purchases through the applicable app-store mechanisms. We may also use backend records to determine entitlement status where needed for service continuity.

## 12. Affiliate, Referral, and Influencer Programs
We may offer referral, affiliate, ambassador, or influencer programs from time to time.
If such a program is offered:
- Participation may be subject to separate program terms, eligibility rules, and commission policies
- Attribution may be time-limited and dependent on valid tracking, subscription status, and anti-fraud checks
- We may withhold, reduce, reverse, or cancel credits, rewards, or commissions in cases of fraud, abuse, self-referrals, chargebacks, refunded purchases, fake accounts, misleading promotion, or other misuse
- We may suspend or terminate participation in any referral or affiliate program at our discretion
Nothing in these Terms guarantees acceptance into, continuation of, or payment under any separate affiliate or referral arrangement.

## 13. Intellectual Property
All intellectual property rights in Naseej, including the app name, brand assets, trademarks, logos, user interface, design, software, code, graphics, and original content provided by us, are owned by us or our licensors.
These Terms do not grant you any ownership rights in our intellectual property. You may not use our trademarks, logos, or brand assets without our prior written consent.

## 14. Privacy and Data Handling
Your use of the Service is also governed by our Privacy Policy. Please review it carefully to understand how we collect, use, store, and handle personal information.
If there is a conflict between these Terms and the Privacy Policy on a matter specifically related to data handling, the Privacy Policy will govern for that issue.

## 15. Data Export, Deletion, and Service Availability
### Deletion
You may request or initiate account deletion through the in-app account tools where available. Deletion may result in permanent loss of your content and account data, subject to any legally required retention, fraud prevention, backup retention, or technical deletion windows.
### Export
If we offer data export, it may be provided directly in the app or through a support-assisted request process.
### Availability
We do not guarantee that the Service, or any specific feature, widget, AI tool, integration, subscription tier, or platform capability, will always be available, uninterrupted, or error-free.
We may suspend, restrict, or discontinue parts of the Service for maintenance, security, legal, operational, or commercial reasons.

## 16. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED **“AS IS”** AND **“AS AVAILABLE”** WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted, secure, or error-free
- The Service will always be available on every device, region, or platform
- Any feature, recommendation, calculation, reminder, or AI response will be accurate or suitable for your needs
- Data stored in the Service will never be lost, corrupted, delayed, or unavailable

## 17. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE.
Our total aggregate liability for any claim arising out of or relating to these Terms or the Service will not exceed:
- the total amount you paid to us through the Service in the **12 months** before the event giving rise to the claim, or
- **USD $10**, if you paid nothing.
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

## 18. Indemnification
You agree to indemnify, defend, and hold harmless the Naseej team and its affiliates, officers, contractors, service providers, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to:
- your use or misuse of the Service
- your content
- your violation of these Terms
- your violation of applicable law
- your violation of any third-party right

## 19. Suspension and Termination
### By you
You may stop using the Service at any time and may delete your account where that functionality is available.
### By us
We may suspend, restrict, or terminate your access to the Service if:
- you violate these Terms
- we reasonably believe your use creates legal, security, abuse, fraud, or operational risk
- we are required to do so by law
- we discontinue the Service or a material part of it
Where reasonable, we will try to provide notice, but we are not required to do so in all cases.
Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination will survive, including Sections 6, 8, 9, 10, 12, 13, 16, 17, 18, 20, and 21.

## 20. Changes to These Terms
We may update these Terms from time to time.
If we make a material change, we will provide notice through the App, by email, or by another appropriate method before the updated Terms take effect, where reasonably possible. Continued use of the Service after the effective date of updated Terms constitutes acceptance of the updated Terms.

## 21. Governing Law and Disputes
These Terms are governed by the laws of the **Kingdom of Saudi Arabia**, without regard to conflict-of-law principles.
Before formally filing a claim, both parties agree to try to resolve disputes through good-faith discussion.
If a dispute is not resolved within **30 days**, it will be submitted to binding arbitration, except that either party may seek injunctive or equitable relief in any court of competent jurisdiction where necessary to protect its rights.
You and we each waive any right to participate in a class action or class-wide arbitration to the extent permitted by applicable law.

## 22. General Terms
- If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
- Our failure to enforce any provision is not a waiver of that provision.
- These Terms, together with the Privacy Policy and any applicable additional terms, form the entire agreement between you and us regarding the Service.
- You may not assign these Terms without our consent. We may assign these Terms as part of a merger, acquisition, restructure, or sale of assets.
